Terms of Service
These terms are the agreement between you and BidDeck for using bid-deck.ai. Please read them — they cover how the trial and subscriptions work, what happens when you cancel, and what we can and can't promise. If something here is unclear, email support@bid-deck.ai.
1. Who we are
BidDeck is operated by Marcel Patillo, a sole proprietor doing business as BidDeck, based in Tennessee (“BidDeck,” “we,” “us”). “You” means the person using BidDeck and, where you use it for a business, that business.
2. What BidDeck is — and isn't
BidDeck helps small businesses find public contract opportunities, understand their requirements, prepare pricing and proposal drafts, and track bids. It is an independent service. It is not affiliated with SAM.gov, the GSA, the State of Tennessee or any government agency, and registering with SAM.gov is free — you never pay us, or anyone, for that.
- We don't submit bids for you. You decide what to bid, review everything you send, and submit through the official channel yourself. We never log into government portals on your behalf.
- Opportunity data comes from public sources such as SAM.gov, USAspending and state procurement sites. Those sources can be incomplete, late or wrong. Always confirm deadlines, requirements and amendments in the official solicitation.
- AI output is a starting point, not advice. Analyses, fit scores, pricing suggestions and proposal drafts can contain mistakes. You are responsible for checking them, and for every claim you make to a buyer — including certifications, insurance, licenses and past performance.
- No guarantee of results. We can't promise you'll win any contract, and BidDeck is not legal, tax, accounting or procurement advice.
3. Your account
You must be at least 18 and able to enter a contract. Keep your sign-in details secure and your information accurate. A company workspace has an owner who controls its plan, billing and members; the owner is responsible for activity in that workspace and for the people they let in.
4. The free trial
- The trial is 30 days of Access, with no card required to start. It runs on a fixed clock from the moment the owner starts it.
- Each person gets one trial. Creating new workspaces or accounts to restart it isn't allowed.
- You can choose a paid plan during the trial. Nothing is charged before the original trial end, and choosing a plan doesn't shorten or restart the trial.
- If the trial ends without payment details on file, the workspace becomes read-only. Nothing you made is deleted, and you can choose a plan at any time to pick up where you left off.
5. Plans, billing and renewal
- Plans and prices are listed on our pricing page. Prices are in US dollars and do not include sales tax, which is added where it applies.
- Subscriptions renew automatically — monthly or yearly, as you choose — until you cancel. You'll see the price, the billing interval and the first charge date, and agree to them, before anything is charged.
- Payments are processed by Stripe. We never see or store your full card number.
- Each plan includes company-wide monthly allowances (for example, AI analyses and proposal drafts). Allowances reset monthly — including on yearly plans — and unused amounts don't roll over. We never charge automatically for going over; you'll simply be told you've reached the limit.
- If we change a price, we'll tell you at least 30 days before it applies, and it takes effect at your next renewal.
- If a renewal payment fails, you keep working on existing bids for 7 days while you update your payment details; new AI generation pauses during that time. After that the workspace becomes read-only until billing is resolved.
6. Cancellation and refunds
- You can cancel any time from Plan & billing or the billing portal. Cancellation stops the next renewal; you keep your paid access until the end of the period you've already paid for.
- We don't give refunds or credits for partial billing periods, unused allowances, or switching to a smaller plan — except where the law requires it, or where we made a billing error, which we'll always correct.
- Cancelling never deletes your work. Your bids and documents stay in your workspace, read-only, so you can come back. To have your data deleted, see our Privacy Policy.
- Questions about a charge: billing@bid-deck.ai.
7. Your content
Everything you add — your company profile, uploaded solicitations, file-cabinet documents, pricing and drafts — stays yours. You give us permission to store, process and display it only as needed to run BidDeck for you, including sending the parts a feature needs to our service providers (for example, a solicitation you ask us to analyze goes to our AI provider). Documents in your file cabinet are not sent to our AI provider. Our Privacy Policy explains the details.
Only upload material you have the right to use. Do not upload classified information, Controlled Unclassified Information (CUI), export-controlled technical data, or anyone else's confidential information you aren't permitted to share. BidDeck is not built or certified to handle those categories.
If you publish your company in the partner directory, other BidDeck companies can see that listing and contact you through BidDeck. You can unpublish at any time.
8. Acceptable use
Don't misuse BidDeck. That includes: breaking the law or a buyer's rules; misrepresenting your certifications, size status or qualifications; trying to access another company's data; scraping, reselling or bulk-copying the service; reverse-engineering it; overloading it; or testing its security without our written permission (if you find a problem, please tell us at support@bid-deck.ai). We may suspend or close accounts that do these things.
9. Our service and changes
BidDeck, its software, design and content (other than yours and public data) belong to us. We keep improving the product, which means features may change. We aim to keep BidDeck available but can't promise it will be uninterrupted or error-free.
10. Disclaimers
To the fullest extent the law allows, BidDeck is provided “as is” and “as available,” without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don't warrant that opportunity data, AI output or calculations are accurate or complete.
11. Limitation of liability
To the fullest extent the law allows, BidDeck will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, contracts or data — including a bid that was late, rejected or lost. Our total liability for any claim relating to BidDeck is limited to the amount you paid us in the 12 months before the claim arose, or $100 if you haven't paid us anything.
12. Indemnity
If someone brings a claim against BidDeck because of content you submitted, statements you made to a buyer, or your breach of these terms, you agree to cover the reasonable costs and losses that result.
13. Ending the agreement
You can stop using BidDeck and cancel at any time. We may suspend or end access for serious or repeated breaches of these terms, for non-payment, or where the law requires it; where we reasonably can, we'll give notice and a chance to export your data first.
14. Changes to these terms
If we make material changes, we'll tell you by email or in the app before they take effect. Continuing to use BidDeck after that means you accept the updated terms.
15. Governing law
These terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Tennessee, and you and we consent to their jurisdiction.
